In accordance with the decisions handed down by the Supreme Court, it is understood that both the elimination of an employment position, as well as the eradication of an organisational unit due to restructuring by an employer, means that a termination of employment is justified. It is extremely important to determine how far an employer is required to formalise the procedures for winding-up the workplace as well as to provide the reasons for the termination of each specific work position. This is also associated with the  complications arising in connection with the necessity of winding-up part of the workplace and the compliance of the employer with the special protection of workers.
